I was standing in a basement in North Nanaimo last week with a young couple. The suite looked perfect, modern floors, bright pot lights, and a tenant already in place. They were ready to write an offer. Then I pulled out my flashlight and looked at the ceiling height and the smoke detectors.
"Guys," I said, "this isn't a legal suite. It’s a 'tolerated' one."
In my years as an Island Realtor, I’ve seen hundreds of these. But as the "Boots on the Ground" expert, my job isn't just to show you the pretty kitchen, it’s to protect your family and your investment.
In Nanaimo, many people think that because a suite has been there for 20 years, it's "grandfathered in." That is a myth. The City of Nanaimo is becoming more proactive. According to Provincial Housing Guidelines, safety is the priority. If a neighbor complains about street parking, an inspector can demand you bring that suite up to the BC Building Code or tear it out.
Many buyers tell me, "John, I’ll just Airbnb the basement to pay the mortgage." Here is the reality: To get a business license for Airbnb or VRBO in Nanaimo, your suite must be authorized. Furthermore, if you want that suite to have a door connecting to your upstairs (internal communication), you must have the correct permits to ensure it meets fire-separation laws. Without these, you are operating at high risk.
When I list a home, I provide the "Full Package", drone, pro video, and floor plans. If your suite is legal, we shout it from the rooftops because it’s worth $30k–$50k more than an unauthorized one. It gives the buyer peace of mind, and it gives you a clean exit when you sell.
Why should I legalize my suite? It protects you from liability and adds significant resale value.
Can the City force me to remove a suite? Yes, if it is unauthorized and a complaint is filed or a safety issue is found.
Do I need a permit for a suite kitchen? Yes, any secondary kitchen requires a building and electrical permit.
What is egress? It means every bedroom must have a window large enough for a person (and a firefighter with a pack) to climb through.
Is it expensive to legalize? It depends on the current state, but fire-rating the ceiling is often the biggest cost.
Does the Residential Tenancy Act apply to illegal suites? Yes. Even if the suite is unauthorized, the tenant has full rights under the BC RTA.
Can I have a suite in Lantzville? Lantzville has its own specific bylaws; always check their Zoning Bylaw.
What about parking? Most zones require at least one additional off-street parking spot for a suite.
Can I connect the suites internally? Only with proper fire-rated doors and City approval.
